Seminar Report: 12th Session of the International Study Group – Overview of the EU data regulatory framework and future outlook

On November 28, the Japan Association of New Economy (JANE) held the 12th Session of the International Study Group.

 At this session, Mr. Noriya Ishikawa, Partner, Nishimura & Asahi; Frankfurt & Düsseldorf Offices Co-Representative, was invited as a guest speaker and provided an overview of the EU data regulatory framework and future outlook, with a focus on the practical implications for Japanese companies.

 At the beginning of the session, he explained that the protection of personal data is granted as a fundamental right under the Charter of Fundamental Rights of the European Union, and that the GDPR serves not only to strengthen data protection but also to promote the free flow of data within the EU.
 He then outlined the expanding scope of EU data legislation, including the Regulation on the free flow of non-personal data and the Open Data Directive, which promotes the secondary use of data held by public sector bodies. He further explained the framework of the Data Governance Act, enacted on the basis of the 2020 European strategy for data.
 In addition, regarding the Data Act, which came into effect on September 12 this year with certain exceptions, he explained key points directly relevant to business practice, such as users’ rights to access data generated by connected products, data sharing obligations that allows users to instruct the transfer of such data to third parties, and rules to facilitate switching between cloud services.
 Finally, he introduced the latest developments under the European Data Union Strategy and the Digital Omnibus that were publicized on November 19 this year, including the concept of the “One Data Act,” which aims to integrate multiple data-related rules into the Data Act, as well as proposed revisions of the GDPR, such as the simplification of personal data breach notification and proposed revisions to cookie consent rules, etc.
 During the Q&A session, active discussions were held on issues of high practical interest, including the handling of statistical data.
