A Statement from JANE Representative Director Mickey Mikitani on the Cabinet Decision on the Partially Amended Payment Services Act

The Japan Association of New Economy (JANE. Location: Minato-ku, Tokyo; Representative Director: Mickey Mikitani) issues the statements of its representative director following the “Cabinet Decision (March 7, 2025) on the bill for the Partially Amended Payment Services Act.
 
1. Regarding “Cross-Border Payment Collection Services,” which will newly be regulated under this amendment, we understand that the Payment Services Act provides a broad definition. Details such as specific scope, exemptions, and other provisions will be determined in the future through cabinet office orders and guidelines.

2. For the new regulation to the “Cross-Border Payment Collection Services,” there have been no cases that would constitute a legislative basis for such regulation, except in special cases like illegal online casinos or investment fraud. As a general rule, the consumer’s obligation is fulfilled upon payment to the collection agent, which contributes to consumer protection. From the perspectives of capturing inbound demand, promoting cashless payments, and alleviating merchants’ fee burdens in cashless transactions, it is essential that the new amendments do not adversely affect existing ecosystems for in-store and e-commerce payments, where no problems have arisen to date. Furthermore, the scope of regulation and obligations should not be excessive in proportion to the risks involved.
 
We urge the government, when formulating exemptions and other detailed provisions through cabinet office orders, to collaborate closely with relevant ministries and stakeholders, including businesses. This collaboration is essential to accurately understand actual practices and to ensure that the scope of regulation and obligations is limited to what is truly necessary.
